Provider
Gem Rush is offered by Dario Aberle (AXATH), Gustav-Heinemann-Str. 37, 28215 Bremen, Germany, [email protected] ("we"). These terms apply when you use the game.
Licence and virtual items
Gem Rush is free to play. We grant you a personal, non-transferable, non-exclusive right to use the game and its content for private purposes. Coins, Gold Bars, Lamp Oil, stones, tools and other virtual items are licensed to you for use in the game only. You do not own them, they have no cash value, cannot be exchanged for money and cannot be sold, traded or transferred.
Purchases
In-app purchases are made only through Apple. Apple's terms apply to payment and refunds; please request refunds from Apple. Nothing you buy is random. When you buy digital content, you ask us to begin delivery immediately and acknowledge that your statutory right of withdrawal expires once we have begun delivery after your express consent (§ 356 (5) BGB). Statutory warranty rights remain unaffected.
Fair play
Do not cheat, use bots, exploit bugs, attack our servers, or buy, sell or trade accounts or items. Usernames must not be offensive or infringe rights of others. If you violate these rules we may, after a warning where reasonable, remove unfairly gained items, change names, and suspend or close your account. Your statutory rights remain unaffected.
Minors
If you are under 18, you may use the game with the consent of your parents or guardians, who are responsible for any purchases.
Health
A small number of people may experience seizures from flashing lights or patterns (photosensitive epilepsy). Stop playing and consult a doctor if you feel dizzy, get a headache or have involuntary movements. Take regular breaks. Parents should supervise young children.
Changes and ending the service
We may update the game and its content. We may change these terms for a valid reason (for example new features or legal changes) only with your consent, which we ask for in the game; if you decline, you can stop playing and delete your account. We may discontinue the game with at least 30 days' notice in the game. You can delete your account at any time in Settings.
Liability
We are liable without limit for intent and gross negligence, injury to life, body or health, under the Product Liability Act, and under guarantees we have given. For slight negligence we are liable only for breach of essential obligations (those on which you may regularly rely), limited to the typical foreseeable damage. Otherwise liability for slight negligence is excluded. We are not responsible for interruptions caused by Apple, network providers or your device, or for data loss not caused by our fault.
Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection law of their country of residence remains unaffected. We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
